EU GPSR Responsible Person

Definition

The EU-based economic operator identified for products covered by the General Product Safety Regulation when required for placement on the EU market.

Overview

EU GPSR Responsible Person The EU-based economic operator identified for products covered by the General Product Safety Regulation when required for placement on the EU market. This article compares that role with similar EU legal contacts — especially authorised representatives used in sectoral legislation — so logistics and compliance teams can pick the right approach for their products.

Operators commonly confuse the GPSR Responsible Person with authorised representatives (ARs) used under specific EU product laws (for example, medical devices, PPE, or machinery). Both provide an EU-based point of contact, but they arise from different legal frameworks, carry different obligations, and are chosen for different circumstances.

Main Legal Differences

  • Legal Basis: The Responsible Person stems from the General Product Safety Regulation (a horizontal instrument); ARs are defined by sectoral legislation (vertical instruments).
  • Scope: Responsible Person covers general consumer product safety across many categories; ARs are specific to regulated sectors with dedicated conformity procedures.
  • Obligations: ARs often have defined duties in the sectoral law (e.g., sign the declaration of conformity, keep technical documentation); the GPSR Responsible Person focuses on ensuring a reachable EU contact and enabling market surveillance.

Operational Consequences For Supply Chains

Choosing the incorrect role can leave gaps in regulatory responsibility. For example, appointing a generic AR for general product safety when the GPSR requires a Responsible Person can cause confusion during enforcement actions. Logistics providers need clarity because accepting any of these roles exposes them to regulatory inquiries and possibly liability for recalls.

When To Use Each Option

  • Use a GPSR Responsible Person: When selling non-sectoral consumer products (toys, textiles, household goods) and you need an EU-based contact for general safety duties.
  • Use an Authorised Representative: When the product falls under sectoral rules that specifically require an AR (for example, certain medical devices or PPE), because those laws confer precise obligations that an AR must meet.
  • Dual Roles: In complex product mixes a company may need both an AR for sectoral compliance and a GPSR Responsible Person for general consumer safety obligations.

Contracting And Liability Considerations

Whether you appoint a Responsible Person or an AR, agreements must specify scope, data access, recall procedures, indemnities, and insurance. Warehouses, fulfilment services, and importers should ensure the appointed party can actually retrieve technical files from manufacturers and has authority to execute recalls and consumer notifications.

Practical Example

A non-EU electronics maker selling smart home devices may face sectoral compliance (e.g., radio equipment rules) requiring an authorised representative and also general safety obligations covered by the GPSR that require a Responsible Person. The seller can appoint an EU-based subsidiary to act as both, provided contracts and capabilities cover both sets of duties. Alternatively, different EU service providers can be appointed, but roles and responsibilities must be clearly separated in writing.

Checklist For Choosing The Right Option

  • Identify Applicable Law: Determine whether the product is covered by sector-specific legislation or only by general safety rules.
  • Assess Capabilities: Verify the EU entity’s ability to hold and produce technical files, respond to authorities, and coordinate recalls.
  • Document Duties: Create written agreements with clear scopes, access rights to WMS and inventory, and responsibilities for consumer communications.
  • Insurance: Confirm professional indemnity and recall insurance are in place if the appointed party assumes significant responsibilities.

In short, the EU GPSR Responsible Person is the EU-based economic operator identified for products covered by the General Product Safety Regulation when required for placement on the EU market. It differs from an authorised representative mainly by legal scope and obligations; choose and contract the correct role based on the product’s regulatory footprint and your supply-chain structure.
