EUDAMED Actor Registration Versus CE Marking: Roles, Timing, And Responsibilities
EUDAMED Actor Registration
Definition
Registration of medical-device economic operators in the EUDAMED actor module.
Overview
EUDAMED Actor Registration is the registration of medical-device economic operators in the EUDAMED actor module. It focuses on identifying and validating the organisations (manufacturers, authorised representatives, importers, distributors) responsible for devices on the EU market; it is complementary to CE marking, which confirms regulatory compliance of the device itself.
CE marking and actor registration address different regulatory needs. CE marking is the conformity declaration attached to a device after demonstrating compliance with the applicable essential requirements and harmonised standards. Actor registration creates the traceable identity of the legal entities that place, import, or represent devices on the EU market. Both are required for lawful market presence but follow separate workflows and are controlled by different actors.
What CE Marking Covers
CE marking addresses product conformity: design, manufacturing, clinical evaluation, risk management, labelling and UDI (where applicable). Notified bodies assess certain devices and issue certificates that support CE marking. The economic operator — typically the manufacturer — declares conformity in a Declaration of Conformity (DoC).
What Actor Registration Covers
Actor registration is about organisational identity and responsibility. The record stores legal names, roles, contact details, and validated mandates (for authorised representatives). Actor IDs in EUDAMED are used to link device records, UDI/device identifiers, certificates, and vigilance reports to specific organisations.
Timing: Which Comes First?
There is no absolute sequencing mandated across all scenarios, but practical sequencing often follows this pattern:
- Manufacturer Prepares Technical Documentation: Complete design and conformity processes and prepare the DoC and UDI data for device registration.
- Authorised Representative Registered: If the manufacturer is non-EU, appoint and validate an EU authorised representative in EUDAMED before or in parallel with device registration so the representative can appear as the regulatory contact.
- Certificates And Device Records Linked: Once actor entries are validated, certificates and device records in other EUDAMED modules are linked to the appropriate actor IDs.
Responsibilities And Legal Consequences
CE marking is the manufacturer’s legal claim of conformity. If a non-EU manufacturer uses an authorised representative, the representative becomes the EU contact and is visible in EUDAMED. Actor registration does not replace the manufacturer’s obligations but ensures the regulator knows who to contact. For importers and distributors, actor registration clarifies liability chains when devices fail or nonconformities arise.
Examples To Highlight Differences
Example 1 — A Class IIa Device From A U.S. Manufacturer:
- CE Marking: Manufacturer completes the conformity assessment, compiles technical file, and signs the DoC; a Notified Body may be involved.
- Actor Registration: The EU authorised representative registers in EUDAMED as the representative and is linked to the device record when the device is entered in the database.
Example 2 — Distributor Importing From An EU Manufacturer:
- CE Marking: The manufacturer supplies a CE-marked device with DoC and UDI information.
- Actor Registration: The importer or distributor only registers if they undertake activities that make them the legal importer; otherwise, the manufacturer remains the registered actor.
Operational Checklist For Compliance Teams
To manage both requirements efficiently:
- Map Roles: Determine which legal entity (manufacturer, authorised representative, importer, distributor) has the responsibility for CE marking and who must be registered in EUDAMED.
- Collect Documents Early: Prepare company registration numbers, VAT IDs, authorised representative mandates, and proof of legal status before starting EUDAMED registration.
- Link Certificates: When notified-body certificates are issued, ensure they are associated with the correct actor IDs in EUDAMED.
Common Mistakes And How To Avoid Them
Avoid mixing up product and organisational responsibilities. Frequent errors include:
- Registering The Wrong Entity: Using a trading name rather than the legal company name can block validation.
- Delaying Authorised Representative Mandates: Waiting to sign and upload mandates creates delays in establishing the EU contact for device files.
- Assuming Registration Is Optional: Some distributors or importers may think registration is optional — confirm the role-specific obligations before acting.
In short, the EUDAMED Actor Registration identifies and validates economic operators in the EU device ecosystem and complements CE marking by providing the named legal entities who are responsible for devices on the market. Treat CE marking as product conformity and actor registration as organisational identity and accountability.
