While some legal requirements mandate sewn-in labels, hang tags commonly supplement those labels with pricing, marketing claims, care instructions, or country-of-origin statements. Understanding which details may be governed by federal or state rules helps prevent compliance failures and product holds at retail or customs.


Federal Rules That Affect Hang Tags


Several federal regulations influence what you may or may not put on a hang tag. The two most relevant are the Federal Trade Commission (FTC) Textile Rules and regulations for children’s products:


  • Fiber Content And Care: The FTC requires accurate fiber content and care information but typically mandates that this information appear on a permanent label attached to the garment. Hang tags can repeat the information but usually do not replace the sewn-in label.

Retailers commonly require clear, truthful pricing on hang tags. Avoid misleading claims (e.g., fictitious original prices) and ensure any discounted or comparison pricing is substantiated and time-limited.


Country Of Origin And Import Considerations


Customs and Border Protection (CBP) requires imported goods to be marked with their country of origin for entry into U.S. commerce. While origin markings are often sewn into garments or on packaging, hang tags can carry origin statements provided they meet the permanence and legibility expectations for the product’s distribution channel. For bulk shipments, ensure packing lists and commercial invoices match the information on tags to avoid delays.


Retailer Requirements And Brand Standards


Major retailers set their own hang tag requirements—placement, size, barcode formats (UPC, EAN), and materials. Noncompliance often results in chargebacks. Before onboarding a retailer, gather their style guides and incorporate them into your tag templates in the WMS or print-on-demand systems.


  • Barcode Format: Retailers typically require a single scannable UPC/EAN sized appropriately and placed consistently on the tag.
  • Placement And Orientation: Retailers may require tags on the back neck, sleeve, or left side seam; inconsistent placement can cause reworks at distribution centers.


Practical Compliance Checklist


  • Verify Labeling Laws: Confirm whether required fiber, care, or safety information must be sewn-in; hang tags may be supplemental only.
  • Match Import Docs: Ensure hang tag country-of-origin matches the shipment paperwork to prevent customs questions.
  • Follow Retailer Specs: Maintain a catalog of retailer tag templates and barcode requirements in your WMS.
  • Keep Records: Archive tag versions, artwork proofs, and compliance certificates for audits.


When To Consult Legal Or Compliance Experts


Complex claims (e.g., sustainability certifications, organic fiber statements) or cross-border distribution warrant counsel. If your hang tags carry performance claims or use third-party logos (e.g., organic, recycled content), secure documentation and permission to use the marks and retain supporting evidence.
