Definition

A liability and insurance concept referring to property possessed, managed, or controlled by a business; it can affect policy exclusions and coverage.

Overview

Care, Custody, or Control A liability and insurance concept referring to property possessed, managed, or controlled by a business; it can affect policy exclusions and coverage.

When a claim arises in the logistics chain, whether the business had Care, Custody, or Control (CCOC) over the damaged property is one of the first questions claims teams evaluate. That determination influences which policy responds, how quickly a claim is paid, and whether litigation follows. Practical claim outcomes depend on policy language, contracts (warehouse receipts, bills of lading), and documentation of custody.

How CCOC Influences Claims Handling

Claims professionals analyze custody and control to route responsibility properly:

  • Coverage Triggers: If a CGL policy contains a CCOC exclusion, adjusters will deny coverage for damaged goods and refer the claimant to cargo or bailee coverages.
  • Primary Versus Excess: Cargo or bailee’s policies often have different deductibles, sublimits, and reporting requirements; knowing which is primary avoids late denials.
  • Proof Of Loss: The claimant must show evidence of custody, condition before loss, and cause — inventory counts, receiving reports, inspection photos, and surveillance video are critical.

Common Policy Exclusions And Endorsements

Typical policy language to watch for:

  • Care, Custody, Or Control Exclusion: Removes coverage for property while in the insured’s control; found in many CGL forms.
  • Bailee’s Customer Coverage: An extension or separate policy that covers customer property held by the insured for a fee.
  • Cargo/Marine Policies: Cover goods in transit and can extend to storage incidental to transit; terms depend on incoterms and bill of lading language.

Documentation That Supports Or Defeats Coverage

Documentation is decisive in claims:

  • Receiving Records: Time-stamped proofs showing when goods were accepted and put into storage establish custody windows.
  • Bills Of Lading/Warehouse Receipts: Legal documents that allocate responsibility and sometimes specify which party insures the goods.
  • Inspection Reports: Pre- and post-loss inspections, photos, and test results (e.g., moisture readings) help establish cause and extent of damage.

Contract Clauses That Change Insurance Outcomes

Contracts can shift risk and clarify which insurance must respond:

  • Indemnity Clauses: Warehousing or carrier contracts often include indemnity that assigns responsibility for negligent acts; insurers may subrogate later.
  • Insurance Requirements: Contracts frequently require carriers or warehouses to carry specified limits for cargo, bailee’s, and liability insurance and to name customers as additional insureds or loss payees.
  • Limitation Of Liability: Bills of lading can limit carrier liability per statute or contract; cargo insurance is then crucial for full recovery.

Operational Steps To Reduce Claims Friction

To speed claims and reduce denials:

  • Standardize Records: Use consistent receiving, storage, and movement logs tied to SKU and pallet IDs to show custody timelines.
  • Maintain Proof Of Insurance: Regularly verify certificates of insurance from carriers and 3PLs and ensure required endorsements are in place.
  • Limit Ambiguity: Use clear contractual language about when custody transfers and who is responsible for loss during storage, handling, and transit.
  • Fast Notification: Report incidents quickly to insurers, because late notice can lead to coverage denial under many policies.

In short, determining Care, Custody, or Control early in a claim decides which policy responds and how losses are allocated. For warehouses and carriers, precise contracts, the right insurance products, and disciplined documentation are the practical controls that prevent coverage disputes and accelerate recovery after a loss.
