International EIN Applicant

Definition

An applicant without a U.S. legal residence, principal place of business, or principal office that uses the IRS's international EIN application methods rather than the online EIN application.

Overview

International EIN Applicant An applicant without a U.S. legal residence, principal place of business, or principal office that uses the IRS's international EIN application methods rather than the online EIN application.

The U.S. Internal Revenue Service provides several alternative filing routes for an International EIN Applicant because the online EIN application is restricted to applicants who have a principal business, office, or legal residence in the United States. International applicants typically use Form SS-4 and submit it by mail or fax, or they call the IRS's international EIN phone line where an IRS representative completes the application on their behalf. Each route has different documentation expectations, timing, and verification steps.

Which Application Methods Are Available

International applicants cannot complete the web-based EIN application. Instead the IRS accepts a completed Form SS-4 via:

  • Fax: A completed SS-4 may be faxed to an IRS fax number specified for international submissions; faxed requests are often processed faster than mail.
  • Mail: The SS-4 can be mailed to the IRS address for applicants outside the U.S.; processing is typically slower and subject to postal delays.
  • Telephone (International Applicants Only): An authorized person can call the IRS international line and provide the SS-4 information verbally; the IRS representative assigns the EIN during the call after verifying details.

What Information The IRS Expects

Whether applying by fax, mail, or phone, the IRS needs the same core data from an international applicant. Completing Form SS-4 carefully reduces follow-up requests and delays.

  • Entity Details: Legal name, trade name (DBA), type of entity (corporation, LLC, partnership, sole proprietorship), and reason for applying.
  • Responsible Party: Name and title of the responsible party; if they have no SSN/ITIN, leave that field blank and note why.
  • Address: Foreign mailing address and, if applicable, a U.S. address for contact or correspondence.
  • Activity And Employees: Description of principal business activity, expected number of employees, and the date the business began or will begin operations.

Practical Step-By-Step Process

Follow these practical steps to submit a complete international EIN application:

  • Prepare Form SS-4: Download the latest Form SS-4 from the IRS website and answer every applicable question. Use clear English and consistent business names across documents.
  • Choose Submission Route: Decide whether to fax, mail, or phone based on how quickly you need the EIN and whether you can receive international calls.
  • Provide Contact Details: Include a reliable international phone number or an authorized U.S.-based contact so the IRS can follow up if needed.
  • Keep Copies: Retain a dated copy of the completed SS-4 and proof of fax or mailing for your records and to support future compliance.

Typical Processing Times And Expectation Management

Processing times vary by submission method and IRS workload. Faxed submissions are often handled in several business days; mailed submissions can take weeks. Applicants who call the IRS international line may receive an EIN during the phone call, assuming the IRS agent can verify the information. Expect follow-up correspondence if the IRS needs clarification or additional documentation.

Who Should Be The Responsible Party And What If There Is No U.S. TIN

The responsible party is the person who controls, manages, or directs the applicant entity and who will sign returns. If the responsible party has no U.S. Social Security Number (SSN) or Individual Taxpayer Identification Number (ITIN), leave that box blank and explain the reason on the SS-4. The absence of a U.S. TIN is common for international applicants and does not automatically block issuance of an EIN, but it may require IRS follow-up.

Tips For Smooth Processing

  • Label: Use consistent legal names and addresses across the SS-4 and any supporting documents to avoid confusion during verification.
  • Label: If you expect U.S. source payments or employees, state that clearly; it helps the IRS route the SS-4 correctly.
  • Label: If applying by phone, have the completed SS-4 in front of you to reduce transcription errors during the call.
  • Label: Use a paid U.S. address or an authorized representative if you need a faster return of documents — but keep records of authorization.

In short, the International EIN Applicant follows a defined set of non-online application methods—mail, fax, or the IRS international telephone service—and should prepare a complete, consistent Form SS-4 with clear contact details to minimize delays and follow-ups.
