How Streamlined Sales Tax (SST) Affects Remote Sellers After Wayfair
Streamlined Sales Tax (SST)
Definition
A multistate initiative designed to simplify and standardize sales and use tax administration among participating U.S. states.
Overview
Streamlined Sales Tax (SST) is a multistate initiative designed to simplify and standardize sales and use tax administration among participating U.S. states. For remote sellers, SST provides a structured path to meet state collection obligations that expanded significantly after the 2018 Wayfair decision.
The Supreme Court’s decision in South Dakota v. Wayfair eliminated the physical-presence requirement for sales tax nexus, allowing states to require remote sellers to collect sales tax based on economic activity. That change made multistate tax obligations a practical reality for many online retailers. SST eases that burden where both the selling business and the destination state participate by offering centralized registration, consistent taxability rules, and certified calculation tools.
How Nexus And SST Interact
Nexus rules determine whether a state can require a seller to collect tax. Wayfair allowed states to set economic nexus thresholds (for example, $100,000 in sales or 200 transactions). If a seller meets a state’s threshold, nexus exists and collection is required. For participating SST states, once a seller needs to collect, SST offers streamlined procedures to register and comply, but it does not alter the underlying nexus thresholds set by each state.
Practical Collection Workflow For Remote Sellers
Remote sellers should follow a clear workflow to use SST effectively:
- Monitor Nexus: Track sales and transaction counts by state to identify when thresholds are met.
- Confirm Participation: Check whether the destination state is an SST member and which SSUTA provisions it has adopted.
- Register Centrally: Use SSUTA’s central registration system to register for multiple participating states where allowed.
- Use Certified Tools: Adopt certified tax calculation software to apply the correct taxability rules and rates for SST states.
- File And Remit: File returns according to SST or state procedures; some states allow consolidated or simplified filings via SST tools.
Marketplace Sales And SST
Marketplaces add another layer. Many states have marketplace facilitator laws that require marketplace operators to collect and remit tax on behalf of third-party sellers. SST’s consistent rules help both marketplaces and sellers understand responsibilities, but sellers must confirm whether the marketplace or seller is the remitting party in each SST state. Where the marketplace collects, sellers may still need to track exempt sales or provide documentation for reimbursements.
Benefits For Remote Sellers Using SST
SST can materially reduce the operational cost of compliance for remote sellers:
- Fewer Registrations: Centralized registration reduces the number of separate state filings.
- Lower Error Risk: Uniform taxability definitions reduce misclassification of products and services.
- Certified Calculations: Standardized, certified rate and taxability logic cuts down on rate errors and audit exposure.
Limits To Expect
Even with SST, remote sellers must be aware of residual obligations:
- Nonmember States: Sales into nonparticipating states still require state-specific registration and compliance.
- Local Taxes: SST covers state-level rules; some local taxes or special district levies may require additional handling.
- Certification Requirements: To claim simplified procedures or protections under SSUTA, sellers often must use certified systems and meet reporting standards.
Example: Remote Seller With Nationwide Sales
A seller in Ohio sells to customers in 30 states. After Wayfair, the seller hits economic nexus in several SST and non-SST states. For SST states, the seller completes central registration, uses a certified tax engine, and files consolidated returns where available. For non-SST states, the seller registers separately and maintains different taxability rules. The net effect is fewer states requiring full manual processes and fewer divergent product classifications.
Operational Checklist For Remote Sellers
- Automate Nexus Tracking: Implement reporting that flags when state thresholds are exceeded.
- Integrate Certified Software: Use SST‑certified or compliant tax engines to reduce calculation errors.
- Review Marketplace Contracts: Confirm whether marketplaces handle collection in each state you sell to.
- Document Exemptions: Keep exemption certificates organized and accessible for audit defense.
In short, the Streamlined Sales Tax (SST) framework gives remote sellers a practical, lower-cost path to comply with the expanded post‑Wayfair collection obligations in participating states, but sellers must still manage nonmember states, local taxes, and marketplace-specific rules.
