Preorder A customer order placed before a product is available for normal fulfillment or release. In the United States, preorders intersect with consumer-protection rules, payment-processing requirements, and tax treatment; merchants must design preorder programs that comply with FTC regulations, card network rules, and state tax laws while minimizing liability.


Consumer protection law requires merchants to ship within promised timeframes or notify customers of delays and provide options. The FTC’s rule governing mail, internet, and telephone orders compels sellers to either ship within the time stated or provide a revised ship date and opportunity for a refund. For preorders with an advertised release date, maintain documentation of that date and any updates you communicate to buyers.


FTC And Shipping Promises


The FTC enforces honest advertising and timely shipping promises. If you advertise a product as available for preorder with a specific ship window, you must ship within that window or notify consumers with an option for a refund. Keep records of marketing claims, email notices, and logistics timelines to respond quickly to any inquiries or enforcement actions.


Payment Card Rules And Chargebacks


Card networks and processors have guidelines for preorders. Common patterns are authorization at checkout and capture at shipment, or immediate capture with clear refund terms. Immediate captures can increase disputes if delivery windows slip; authorization-and-capture helps mitigate chargeback risk but requires robust retry and capture workflows when cards expire before shipment.

For accounting, follow GAAP or ASC 606 guidance: recognize revenue when control of the goods transfers (usually at shipment) unless collectibility or other criteria alter revenue recognition timing.

Because customers may change their minds during long lead times, decide whether cancellations are permitted before shipment and whether refunds will be immediate. Customer service scripts should align with payment capture timing—refunds for captured charges should be processed promptly to avoid disputes.

  • Advertising Records: Keep copies of preorder ads and product pages showing ship estimates.
  • Communication Logs: Archive outbound emails and status updates to customers.
  • Tax Determination: Document state tax treatment and where you collect prepayment sales tax.
