UK Cosmetic Responsible Person

Definition

UK-established person or company responsible for ensuring a cosmetic product placed on the Great Britain market complies with applicable cosmetic rules.

Overview

UK Cosmetic Responsible Person UK-established person or company responsible for ensuring a cosmetic product placed on the Great Britain market complies with applicable cosmetic rules.

After the UK’s regulatory separation from the EU, brands must understand how a UK Cosmetic Responsible Person differs from an EU Responsible Person (RP). Both roles share core duties — ensuring product safety, holding technical documentation, and acting as the interface with regulators — but the legal bases, notification systems, and territorial scopes differ. Brands selling across both jurisdictions commonly need two distinct RPs or an RP network that covers both the UK and EU markets.

Legal Basis And Territorial Scope

The EU role is grounded in Regulation (EC) No 1223/2009; the UK role rests on retained domestic legislation and secondary instruments. The EU RP serves the EU single market; the UK RP serves Great Britain. Northern Ireland occupies a third regime under the Northern Ireland Protocol, where EU rules and EU Responsible Persons may still apply. For clarity:

  • Geographic Scope: EU RP: EU27 + EEA (as applicable). UK RP: Great Britain only (England, Scotland, Wales).
  • Northern Ireland: May require EU RP approaches due to the Protocol; check import route and market target.

Notification Platforms And Data Requirements

The EU maintains the Cosmetic Product Notification Portal (CPNP). Great Britain uses separate domestic arrangements and data sharing mechanisms. The Responsible Person’s duties include submitting required product information to the correct national portal or database. This means manufacturers used to a single EU submission will need to add a UK submission pathway or work with a UK RP to handle notifications.

Labeling And Market Statements

Labels must list the Responsible Person’s name and address appropriate to the market. An EU RP address on a product sold in London is insufficient for GB market enforcement. Consequently, packaging for goods destined for Great Britain must show a UK-based contact or the importer/distributor that is the RP.

Liability And Enforcement Dynamics

Enforcement bodies operate within their jurisdictions. An EU RP cannot be treated as a UK RP by GB authorities unless also established in the UK. This affects recall flow, expedited market withdrawal, and investigative powers. Brands need contractual clarity about who will manage immediate market actions and bear costs if issues arise in either market.

Commercial Options For Cross‑Market Brands

  • Dual RPs: Appoint both an EU and a UK Responsible Person to cover each market explicitly.
  • Local UK Service: Non‑UK brands can contract a UK RP to handle GB obligations while retaining an EU RP for the EU market.
  • Distributor/Importer RP: Use a UK-based importer or distributor as RP where appropriate and acceptable under commercial terms.

Practical Example

A UK retailer imports an EU-made shampoo that lists only the EU Responsible Person on the label. To sell that shampoo in Great Britain, the retailer either must become the UK Responsible Person and add their UK contact details to the label, or require the manufacturer to appoint a UK RP and change packaging or include a UK contact insert.

Tips For Managing Both Regimes

  • Audit Your Labels: Identify which SKUs target GB vs EU and confirm the correct RP details are present.
  • Contractual Coverage: Ensure service-level agreements cover notifications, adverse event handling and recall obligations by territory.
  • Documentation Sync: Keep the PIF, safety assessments and batch traceability aligned between RPs; duplication is normal but must be controlled.

In short, the UK Cosmetic Responsible Person performs many of the same functions as an EU RP but under UK domestic rules and for the Great Britain market; cross‑market brands must address differences in notification portals, label requirements and enforcement reach when designing compliance strategies.
