Overview

MoCRA Cosmetic Product Listing FDA product listing required for marketed cosmetic products by the responsible person under MoCRA, subject to applicable exemptions.

The Modernization of Cosmetics Regulation Act of 2022 (MoCRA) changed how cosmetics sold in the United States are tracked and regulated. One of the law's core requirements is that a designated ‘‘responsible person’’ must provide the Food and Drug Administration (FDA) with a listing of cosmetic products they market. The goal is to improve transparency, allow faster public-health responses, and create a central record of products, responsible parties, and key product details.

What The Listing Typically Includes

The statute and implementing FDA guidance specify categories of product information that the agency will need to identify and assess a cosmetic product quickly. Expect the listing to cover:

  • Product Identifier: The marketed name and any size/format identifiers so the product can be matched to labels and shipments.
  • Responsible Person Contact: The company or individual designated under MoCRA who is legally responsible for compliance.
  • Manufacturer And Facility: Where the product is manufactured, and potentially packagers or private-labelers involved in production or distribution.
  • Ingredient Information: Ingredient names (typically INCI where used), concentrations or an ingredient statement to allow safety review.
  • Intended Use/Claims: Marketing claims or intended use that affect product classification (purely cosmetic vs. drug/device).

Why The Requirement Matters

Listing creates a single point of contact for FDA and public-health agencies to assess adverse events, identify products in recalls, and investigate safety signals. For warehouses, retailers, and 3PLs, it means faster product traceability and clearer recall instructions; for merchants, it adds an administrative step but reduces risk of delayed response to safety questions.

How It Affects Different Stakeholders

  • Merchants: Must confirm who the responsible person is for each product you market and ensure the product is listed when required.
  • Private-Labelers: Often act as responsible persons and must collect and submit listing information for items sold under their brand.
  • Wholesalers and Distributors: Should track listing status for products they handle to support recalls and regulatory queries quickly.
  • Manufacturers: Need to provide accurate ingredient and facility data to the responsible person to enable listing.

How Listing Requirements Vary

Not every product is treated identically. Products that make drug claims, devices, or biologics follow different regulatory pathways, and products sold only for export or used strictly for research may be treated differently. MoCRA also allows for statutory or regulatory exemptions; responsible persons should consult the statute and FDA guidance to determine applicability.

Practical Example

A small cosmetics brand that sells a moisturizing lotion online designates itself as the responsible person. To comply it collects the product's marketed name and SKU, the INCI ingredient list supplied by its contract manufacturer, the manufacturer's U.S. facility address, and a copy of the product label. The brand submits these details to the FDA as part of its product listing. When a single-batch contamination issue later occurs, the listing allows the agency to identify the responsible person quickly and issue targeted guidance to retailers and consumers.

Tips For Responsible Persons

  • Centralize Records: Keep label files, ingredient declarations, and manufacturing contracts in a shared folder to speed future listings and inspections.
  • Confirm INCI Names: Use standard INCI names for ingredients where applicable — it reduces confusion in safety reviews and matches industry databases.
  • Coordinate With Partners: Ensure contract manufacturers and private-label partners understand their role in providing accurate facility and ingredient information.
  • Monitor FDA Updates: FDA will publish implementation guidance and systems to receive listings — watch the FDA MoCRA page for changes.

In short, the MoCRA Cosmetic Product Listing creates a mandatory record of marketed cosmetics and the responsible parties. For responsible persons, timely, accurate listing and organized supporting records reduce regulatory risk and make supply-chain responses faster and more reliable.
